These Terms of Service (“Terms”) govern your use of the website and mobile applications (the “Apps”) provided by FLUXXIO LLC (“we”, “us”, “our”). By downloading, accessing or using the Apps, you agree to these Terms. If you do not agree, please do not use the Apps.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Apps. If you are under the age of majority where you live, you may use the Apps only with the involvement and consent of a parent or legal guardian.

2. License

We grant you a personal, limited, revocable, non‑exclusive, non‑transferable license to download and use the Apps on devices you own or control, solely for your personal, non‑commercial use, subject to these Terms and the usage rules of the Apple App Store or Google Play.

3. Accounts

Some Apps may let you create an account. You are responsible for keeping your login details secure and for all activity under your account. Please notify us promptly of any unauthorized use. You can delete your account at any time as described in our Privacy Policy.

4. Acceptable use

You agree not to:

Copy, modify, reverse engineer, decompile or attempt to extract the source code of the Apps, except where permitted by law
Interfere with or disrupt the operation, security or servers of the Apps
Use the Apps for any unlawful, fraudulent or harmful purpose
Circumvent any access controls, purchase verification or usage limits
Use bots, scrapers or other automated means to access the Apps
Upload or share content that infringes others' rights or is illegal, abusive or harmful

5. Your content

You keep ownership of any content you create or upload in the Apps. You grant us a limited license to store, process and display that content only as needed to operate and provide the Apps to you. You are responsible for your content and for having the rights to use it.

6. Purchases & subscriptions

Some Apps offer paid features, in‑app purchases or subscriptions. Prices are shown in the App and the store before you buy. Payments are handled by Apple or Google and charged to your store account.

Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the end of the current period.
You can manage and cancel subscriptions in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
Refunds are subject to the policies of Apple or Google.
We may change prices for future periods; you'll be notified in advance as required by the store and applicable law.

7. Intellectual property

The Apps and all related content, software, designs, graphics, trademarks and logos are owned by FLUXXIO LLC or its licensors and are protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

8. Third‑party services

The Apps may include links to or integrations with third‑party services. We are not responsible for third‑party content, services or practices, and your use of them is governed by their own terms and policies.

9. Updates & availability

We may release updates that add, change or remove features, and some updates may be required to keep using the Apps. We do our best to keep the Apps available but do not guarantee they will be uninterrupted or error‑free, or available in every country.

10. Disclaimer

The Apps are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non‑infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, FLUXXIO LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of or inability to use the Apps. Our total liability for any claim relating to the Apps will not exceed the amount you paid us for the App in the 12 months before the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless FLUXXIO LLC from claims, damages and expenses (including reasonable legal fees) arising from your misuse of the Apps or violation of these Terms, to the extent permitted by law.

13. Apple‑specific terms

If you downloaded an App from the Apple App Store, you acknowledge that:

These Terms are between you and FLUXXIO LLC, not Apple, and FLUXXIO LLC is solely responsible for the App and its content.
Apple has no obligation to provide support or maintenance for the App.
If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation.
Apple is not responsible for addressing claims relating to the App, including product liability, legal or regulatory compliance, or intellectual property infringement claims.
You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you.

14. Google Play terms

If you downloaded an App from Google Play, you also agree to the Google Play Terms of Service. In case of conflict between these Terms and Google Play's terms regarding your use of the store, Google Play's terms apply.

15. Changes & termination

We may update these Terms from time to time; changes will be posted on this page with a new “Last updated” date. Continued use after changes means you accept the updated Terms. We may suspend or terminate your access if you violate these Terms, and we may discontinue the Apps at any time. You may stop using the Apps at any time by deleting them.

16. Governing law

These Terms are governed by the laws of the State of [STATE], United States, without regard to conflict‑of‑law principles. Nothing in these Terms limits any rights you have as a consumer under the mandatory laws of your country of residence.
